1. Acceptance of Terms

By creating an account, purchasing a license, downloading, installing, or using WhatsApp Forensicator (the "Software"), you agree to be bound by these Terms & Conditions. If you do not agree, do not install or use the Software. The Software is published by Cyber Octopus Pvt. Ltd. ("Cyber Octopus", "we", "us").

2. Lawful Use & Authorization

The Software is a digital forensics tool intended for law enforcement, forensic professionals, corporate investigators, and individuals analyzing their own data. You agree to use it only:

• on devices and data you own, or
• with the explicit, documented legal authorization of the device owner, or
• under a valid legal mandate (warrant, court order, or equivalent) in your jurisdiction.

You are solely responsible for ensuring your use complies with all applicable laws, including privacy, surveillance, and data protection laws. Unauthorized access to another person's device or communications is illegal in most jurisdictions.

3. License Grant

Upon payment confirmation, we grant you a limited, non-exclusive, non-transferable license to install and use the Software:

• on one computer (the license is hardware-locked / HWID-bound to the machine you activate it on);
• for the duration of your purchased plan;
• for lawful personal or professional forensic use.

If you need to move your license to a new machine (e.g. hardware failure or upgrade), contact support — genuine transfer requests are handled on a case-by-case basis.

4. Prohibited Uses

You may not:

• use the Software for illegal surveillance, stalking, or unauthorized access to any person's device or data;
• share, resell, rent, or sublicense your license key or account;
• reverse engineer, decompile, disassemble, or modify the Software, or attempt to bypass its licensing or hardware-lock mechanisms;
• use the Software to develop a competing product;
• misrepresent extracted evidence or use the Software to fabricate evidence.

Violation of this section terminates your license immediately, without refund.

5. Accounts & Payments

You must provide accurate information when registering and keep your credentials confidential; you are responsible for activity under your account. Payments are verified manually — your subscription activates once payment is confirmed by our team. Pricing and plan features are as listed on the Pricing page at the time of purchase. Refunds are governed by our Refund Policy.

6. Data & Privacy

All forensic processing is local to your machine, as described at the top of this page. The Software contacts our servers only to activate or validate your license and to check for software updates — these requests carry your license key, hardware ID, and app version, and never any extracted content. Our full data practices are described in the Privacy Policy.

7. Software Updates & Compatibility

We may release updates that improve, modify, or remove features. Device and OS compatibility (e.g. Android version support for non-root extraction) can change as platform vendors change their security models; we do not guarantee that every extraction method works on every device or OS version. Feature availability may differ by plan tier.

8. Intellectual Property

The Software, including its code, design, branding, and documentation, is the property of Cyber Octopus Pvt. Ltd. and is protected by copyright and other intellectual property laws. These terms grant you a license to use the Software — not ownership of it. WhatsApp is a trademark of its respective owner; WhatsApp Forensicator is an independent tool and is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta.

9. Disclaimer of Warranty

The Software is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted, error-free operation. We do not warrant that extracted data will be complete, that every device is supported, or that results will be admissible as evidence in any particular proceeding — admissibility depends on your jurisdiction and how the evidence was collected.

10. Limitation of Liability

To the maximum extent permitted by law, Cyber Octopus Pvt. Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of data, profits, or business, arising from your use of (or inability to use) the Software — including any misuse of the Software by you or any third party. Our total liability for any claim shall not exceed the amount you paid for your license in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your license if you breach these terms, with no refund in cases of misuse or license sharing. You may stop using the Software at any time. Sections 8–10 survive termination.

12. Changes to These Terms

We may update these terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Software after changes take effect constitutes acceptance of the revised terms.

13. Governing Law & Contact
